PLEASE READ THESE TERMS OF USE CAREFULLY. BY DOWNLOADING, ACCESSING, OR USING THE ROOMISH AI MOBILE APPLICATION (THE "APP" OR THE "SERVICE"), YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY.

1. Acceptance of Terms

These Terms form a legally binding agreement between you ("User", "you") and Roomish AI ("Company", "we", "us").

By using the App, you confirm that:

• you have read and understood these Terms
• you agree to comply with them
• you agree to the terms outlined in the Privacy Policy

2. Modifications to Terms

We may update these Terms at our sole discretion.

If changes are made:

• the updated Terms will be posted in the App
• the "Effective Date" will be revised

Your continued use of the App after updates indicates acceptance of the revised Terms.

If you do not agree with the changes, you must stop using the App.

3. Eligibility

By using the App, you confirm that:

• you comply with the laws of your jurisdiction
• you have the legal capacity to enter into agreements in your country
• you are at least 13 years of age (or the minimum age required in your jurisdiction to enter into a legal agreement)
• if you are under 18, you have obtained parental or guardian consent to use the App and agree to these Terms

4. Description of the Service

Roomish AI provides tools for AI-powered image generation and transformation.

The App includes the following features:

• Room Redesign — generating interior concepts based on photos submitted by the user
• Reference Design — applying stylistic transformations using a reference image
• AI Recolor — selectively recoloring or modifying elements within an image
• My Designs — a personal gallery where your uploaded photos and AI-generated results are stored for easy access and management

Additional information:

• The Service relies on third-party AI models
• Generated output may be imperfect or inaccurate
• The App is intended for creative inspiration only and does not provide professional design, architectural, engineering, or construction advice
• An internet connection is required for AI image generation. You can browse the App, configure design settings, and view saved results in My Designs while offline. Your progress is preserved and generation can be completed once connectivity is restored.

5. Important AI Disclaimer

You understand and agree that:

• AI-generated results may contain errors, distortions, artifacts, or inconsistencies
• results may not match real-world conditions or your expectations
• generated output is automatic and may not follow instructions precisely
• the App is not a substitute for professional consultation
• decisions made based on AI output are your own responsibility
• you use AI-generated content entirely at your own risk

We do not guarantee that generated outputs will match user instructions, expectations, or uploaded reference images.

6. User Content and Data Storage

"User Content" includes:

• photos
• reference images
• AI-generated results based on your uploads

By uploading User Content, you confirm that:

• you own the content or have permission to use it
• your content does not violate third-party rights
• your content complies with all applicable laws

Ownership:

• You retain all rights to your User Content
• You grant us a non-exclusive license to process your content solely to operate the Service

Photo Processing and Storage:

When you upload a photo:

• The photo is processed by AI to generate design results
• Both the original photo and generated results are saved to "My Designs"
• You can delete original photos or generated results at any time

Data Retention in "My Designs":

• Images (both originals and results) are stored on our servers while saved in "My Designs"
• When you delete images from "My Designs", they are permanently removed from our servers
• Images are retained while you have an active subscription
• If you cancel your subscription and remain inactive for 90 days, all stored images will be automatically deleted
• We recommend saving important photos and designs to your device before canceling or deleting the App
• If you delete and reinstall the App, your subscription can be restored via App Store (Restore Purchase), but previously generated images and saved designs cannot be recovered
• Since the App does not require sign-in, generated content is not linked to a user account and cannot be transferred between installations

We do not use your photos for:

• Training AI models
• Marketing or promotional purposes
• Any purpose other than providing the Service to you

7. Technical Data and Anonymous Identifiers

The App operates without user accounts or sign-in.

When you use the App, the system generates technical identifiers, such as:

• anonymous device IDs (via Firebase Analytics)
• session IDs
• request identifiers
• a persistent device identifier stored locally on your device (via Keychain) and transmitted to our servers to manage free generation limits and prevent abuse

These identifiers:

• do not include your name, email, or contact information
• are not linked to any personal account or profile
• may uniquely identify your device but cannot identify you as an individual person
• are used only to operate the Service and process your requests

Data Retention:

• Technical identifiers and processing data are used temporarily to deliver the Service
• All user-specific data is permanently deleted when you delete the App from your device, except the persistent device identifier (stored in Keychain) which is retained to enforce free generation limits
• We do not maintain user accounts or store personal information

8. Subscriptions

The App offers weekly, monthly, and yearly PRO subscriptions.

PRO Subscription (Active Subscribers):

• Unlimited image generations without watermarks
• Priority processing for faster generation times
• Access to new premium features as they become available
• Subscriptions are available in weekly, monthly, and yearly plans

Free Users (No Subscription):

• Each new user receives three free image generations (with watermark)
• Free generations do not include priority processing
• Free generations are granted once per device
• Reinstalling the App does not reset free generation credits
• The App uses a persistent on-device identifier to verify eligibility

Free Trial (Monthly and Yearly Subscriptions):

• Weekly subscription: no free trial
• Monthly subscription: 3-day free trial
• Yearly subscription: 7-day free trial
• If not cancelled at least 24 hours before the trial ends, it converts into a paid subscription
• During the free trial, you have full PRO access: unlimited generations, no watermarks, and priority processing

Images generated during an active free trial or paid subscription do not include watermarks.

Auto-Renewal & Billing:

• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the billing period
• All subscriptions are processed through Apple App Store
• Billing, cancellations, and refunds are managed via your Apple ID
• We do not have access to your payment information
• We do not issue refunds for unused time or accidental purchases
• Payment will be charged to your Apple ID account at confirmation of purchase
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase

To cancel your subscription:

• Go to Settings > Apple ID > Subscriptions on your device
• Select Roomish AI and choose "Cancel Subscription"

Trial Forfeiture:

• Any unused portion of a free trial is forfeited once a paid subscription begins

Pricing:

• Pricing is displayed in the App and App Store at the time of purchase
• Prices may vary by region and are subject to change

9. Permitted and Prohibited Use

Permitted Use:

You may use AI-generated content for:

• personal projects
• commercial purposes (design presentations, real estate marketing, client work)
• social media and portfolios

Provided that you:

• do not misrepresent AI output as human-created professional architectural or engineering plans
• understand that AI results are for inspiration and visualization only
• do not use them as final construction or engineering documents

Prohibited Use:

You may not use the App to generate or upload:

• illegal content
• harmful, abusive, or hateful content
• content that infringes copyrights, trademarks, or personal rights
• sexually explicit or pornographic content
• content depicting real people without their consent
• content intended to defraud, deceive, or mislead others

You also agree not to:

• reverse engineer, copy, modify, or decompile the App
• upload copyrighted/trademarked materials without permission
• resell or redistribute AI generation as a standalone product or service
• interfere with or disrupt the Service
• attempt to access systems or data without authorization
• use the App to spam or abuse the Service

You are fully responsible for your use of the App.

10. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis.

We do not guarantee:

• uninterrupted operation of the App
• accuracy, reliability, or completeness of generated results
• compatibility with all devices
• absence of errors, defects, or technical issues

AI results are intended for inspiration only and should not be interpreted as professional advice.

You use the App at your own discretion and risk.

11. Limitation of Liability

To the extent permitted by applicable law:

• the Company is not responsible for indirect, incidental, or consequential damages resulting from your use of the App
• AI-generated results may not reflect real-world conditions
• you are solely responsible for how you interpret and use generated content

In no event shall our total liability exceed the amount you paid to us in the 12 months preceding the claim, or $50 USD, whichever is greater.

12. Indemnification

You agree to use the App responsibly.

If your actions cause a legal claim against the Company (e.g., due to uploading content that violates someone else's rights), you agree to resolve the matter without involving the Company where possible.

This clause applies only to misuse caused directly by the user and does not limit your consumer rights.

13. Termination

We may:

• limit access
• suspend your use of the App
• or remove violating content

if we believe you are breaching these Terms or interfering with the Service.

In most cases, we will attempt to resolve issues before restricting access.

You may stop using the App at any time by deleting it from your device.

14. Governing Law

These Terms are governed by widely accepted principles of international contract law.

You agree to attempt to resolve disputes through direct communication before taking formal action.

Nothing in these Terms limits your rights under the mandatory consumer protection laws of your jurisdiction.

15. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and Roomish AI.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
